Pursuant to United States Code of Federal Regulations Title 49—Transportation, Subtitle A, Part 26 (49 CFR 26), Executive Directive No. 2001-26 of Mayor Richard Riordan and the Provisions of Resolution No. 19765 of the Board of Airport Commissioners, it is the policy of Los Angeles World Airports (LAWA) to provide Disadvantaged Business Enterprises (DBEs) an equal opportunity to participate in the performance on all LAWA contracts. The objective of this policy is to achieve the participation of DBEs at levels comparable to their availability to provide goods and services to Los Angeles World Airports, with the ultimate goal of developing their status and expertise so that they may compete for future contracts on an equal basis.

The California Department of Transportation has implemented a wholly race-neutral Disadvantaged Business Enterprise (DBE) Program, effective May 1, 2006. The Program may be an interim step, pending the results of an availability and a disparity study to guide administration of the Department’s DBE Program in accordance with 49 Code of Federal Regulation (CFR) Part 26.

During this interim period, the Department of Transportation determined that the DBE Program is a viable and integral element of California’s construction program and is a requirement for receipt of federal transportation assistance.

LAWA supports the use of race neutral measures to facilitate participation by DBEs and other small businesses, and encourages prime contractors to subcontract portions of their work.

LAWA’s annual FAA approved DBE goal for fiscal year 2010 is 21.03%. Until such time that a disparity study is adopted, we will achieve this goal on federally assisted projects through race neutral measures. However, LAWA encourages bidders and proposers to assist us in attaining this goal. A participation form must be included with the bid/proposal identifying the DBE firms participating in the project.
