VNY Grandfathered Phaseout of Noisier Aircraft Schedule/Project Status

The City of Los Angeles and LAWA implemented the VNY Noisier Aircraft Phaseout ordinance via the following steps:

  April 17, 2006  Board of Airport Commissioners reintroduced Resolution 17154 regarding re-initation of a seven-year phaseout of Stage 2 aircraft from VNY. The phaseout ordinance was originally introduced June 13, 1990 and is considered "grandfathered" pursuant to the Airport Noise and Capacity Act of 1990 (ANCA) and the Part 161 regulations.   
  July 17, 2006  Presentation to the Board of Airport Commissioners on the grandfathered phaseout and the status of the VNY Part 161 Study.
  August 20, 2007  Board of Airport Commissioners adopted Resolution 23390 approving amendments to the proposed VNY Noisier Aircraft Phaseout ordinance and authorized circulating the draft ordinance for environmental review.
  November 15, 2007  Public scoping meeting for a Focused Environmental Impact Report (EIR) prepared under the California Environmental Quality Act (CEQA) for the grandfathered phaseout of noisier aircraft at VNY.
  October 7, 2008  The first public workshop on the draft Environmental Impact Report (EIR) prepared under the California Environmental Quality Act (CEQA) for the grandfathered phaseout of noisier aircraft at VNY.
  November 5, 2008  A second public workshop was held on the draft Environmental Impact Report (EIR) for the grandfathered phaseout of noisier aircraft at VNY.
  March 9, 2009  Final EIR published.
  May 4, 2009  The Board of Airport Commissioners approved Resolution 23779 recommending City Council adoption of the "Van Nuys Airport Noisier Aircraft Phaseout Ordinance with Historic, Maintenance, and Stage 3 and 4 Aircraft Exemptions" (Alternative 2 in the Final EIR).
  February 1, 2010  Presentation to the Board of Airport Commissioners: "VNY Part 150 and Part 161 Status Update."  
  February 3, 2010  City Council Trade, Commerce, and Tourism Committee approved proposed ordinance.  
  February 26, 2010  City Council approved ordinance.
  March 9, 2010  Mayor signed ordinance.
  April 15, 2010  Ordinance 181106 went into effect.

LAWA received written confirmation from FAA that the proposed phaseout of the noisier aircraft ordinance would be grandfathered under ANCA and not subject to that statute’s requirements (i.e., the analysis, documentation, and notice requirements implemented through Part 161) subject to inclusion of exemptions for Part 36 Stage 3 and 4 aircraft, as evaluated as Alternative 2 in the Final Environmental Impact Report (EIR) prepared under the California Environmental Quality Act (CEQA) for the noisier aircraft phaseout. The following correspondence documents LAWA and FAA consultation leading to this confirmation:

  • December 11, 2008  letter from FAA to LAWA requesting information from LAWA and a meeting with LAWA regarding LAWA’s position that the proposed phaseout is grandfathered.
     
  • February 2, 2009  LAWA response to FAA request for information and consultation regarding LAWA’s position that the proposed phaseout is grandfathered.
     
  • March 19, 2009  Letter from FAA to LAWA confirming that the proposed phaseout ordinance is eligible for a grandfather subject to inclusion of exemptions for Part 36 Stage 3 and 4 aircraft, as evaluated as "Alternative 2" in the Final EIR for the noisier aircraft phaseout.
     
  • May 11, 2009  Report from City Attorney to the City Council transmitting draft phaseout ordinance to the City council for action.
     
  • May 12, 2009  Letter from Board of Airport Commissioners to the City Council requesting that the City Council certify the Final EIR and adopt the California Environmental Quality Act Findings, the statement of Overriding considerations, and the Van Nuys Airport Noisier Aircraft Phaseout Ordinance with Historic, Maintenance, and Stage 3 and Stage 4 Exemptions (known as "Alternative 2" in the Final EIR).
     
  • March 9, 2010  Mayor signed ordinance 181106.
     
  • April 15, 2010  Ordinance 181106 went into effect.

     

Summary of Phaseout Ordinance Provisions 

The phased reduction in maximum takeoff noise levels would be as follows:

  • On or after January 1, 2009: No aircraft may arrive or depart VNY whose takeoff noise level equals or exceeds 85 A-weighted decibels (dBA).

  • On or after January 1, 2011: No aircraft may arrive or depart VNY whose takeoff noise level equals or exceeds 83 dBA.

  • On or after January 1, 2014: No aircraft may arrive or depart VNY whose takeoff noise level equals or exceeds 80 dBA.

  • On or after January 1, 2016: No aircraft may arrive or depart VNY whose takeoff noise level equals or exceeds 77 dBA.

The noise limits do not apply to military aircraft, government owned aircraft involved in emergency response operations (law enforcement, fire, search & rescue), medical mercy or life flights, and the operation of Stage 3 and 4 certified aircraft. The ordinance also exempts operations of aircraft that are permanently departing VNY, and of historic types first flown before 1950. Operations of former military aircraft that are now privately owned, and operations related to aircraft major maintenance and repairs are exempt until 2016.
